イタリアが生んだ18世紀最大の法学者ベッカリア(1738-1794)の代表著作。彼はロンバルディの民法刑法改正委員会委員を務めたが、ミラノ大学では法学・経済学をも教授し、A・スミスやマルサスの経済理論を先取りする講演を行なったことでも有名である。本書は、残虐な拷問や死刑の非を主張し、教育による犯罪の防止を訴えた名著の英語版で、ベッカリアの理論に関するヴォルテール(1694-1778)の貴重な注釈を併せて翻訳したものである。
